6. Trader’s Obligations
We are responsible for providing products that comply with the terms agreed with the customer.
A product is considered compliant with the agreed terms if it matches the description provided on the Website and has the qualities presented to the customer before purchase.
Where no specific description is provided, the product must be suitable for the purpose for which similar products are normally used, or for any specific purpose that the customer informed us of before purchase and which we accepted.
7. Legal Warranty for Faulty Products
If a product is faulty, defective or does not comply with the agreed terms, the customer may have the right to request:
- repair of the defect;
- replacement of the product;
- reduction of the price;
- withdrawal from the contract, where permitted by law.
Repair or replacement are the customer’s primary remedies, except where repair or replacement is impossible, disproportionate or would require unreasonable cost considering the nature of the product.
Where applicable, replacement should be carried out within a reasonable period and no later than 10 calendar days from the discovery of the defect. Standard repair should be carried out within a reasonable period and no later than 30 calendar days from the discovery of the defect.
Repair or replacement of a faulty product shall be free of charge for the customer, including necessary postage, labour and material costs.
The customer may request a price reduction or withdraw from the contract if:
- repair or replacement is impossible;
- we fail to repair or replace the product within a reasonable period;
- repair or replacement would cause significant inconvenience to the customer;
- the customer has lost interest in performance of the contract due to delay or defect.
The customer may not withdraw from the contract if the defect is minor.
The customer may exercise these rights if the defect is discovered within 2 years from receiving the product.
If the defect is discovered within 6 months from receiving the product, it is presumed that the defect existed at the time of delivery, unless this is incompatible with the nature of the product or the nature of the defect. In such case, the burden of proof lies with the trader.
If the defect is discovered after 6 months, the customer must prove that the defect existed at the time of delivery.
8. Orders
To place an order, you must select the product, add it to your cart and complete the checkout process.
Before submitting your order, please check that all information is correct, including:
- selected products;
- quantity;
- delivery address;
- contact details;
- payment information.
After placing an order, you may receive an order confirmation email. This confirms that we have received your order.
We reserve the right to refuse, cancel or limit an order where:
- the product is unavailable;
- payment is not completed or authorised;
- the information provided is incorrect or incomplete;
- we identify a pricing or product description error;
- we suspect fraudulent, unauthorised or abusive activity;
- the order appears to be placed for unauthorised resale or commercial misuse.
If we cannot deliver the product, the order may be cancelled and the customer will receive a refund of the amount paid.
The order is considered completed once the product has been delivered to the customer.
9. Order Processing and Delivery
After payment is received, we will process the customer’s order within no more than 2 business days, unless otherwise stated on the Website or agreed with the customer.
Delivery should not exceed 3 days after order processing, unless a different delivery timeframe is specified at checkout or on the relevant delivery page.
The customer is responsible for providing accurate delivery information.
Upon receiving the order, the customer should inspect the product and confirm that it has no visible defect or damage.
Upon request, we will provide the customer with order-related documents, including invoice or payment confirmation, where applicable.
10. Delivery Fees
Delivery terms and fees may vary depending on the delivery location.
- Delivery in Tbilisi may be provided free of charge, unless otherwise stated on the Website.
- Delivery to regions may be subject to additional courier or postal service fees, calculated according to the relevant regional tariff.
Delivery options, estimated delivery times and applicable delivery costs will be displayed at checkout or provided on the relevant delivery/shipping page of the Website.
LuxElle is not responsible for delays or failed delivery caused by incorrect or incomplete address details provided by the customer.
Risk in the products passes to the customer once the products are delivered to the delivery address provided in the order.
11. Prices and Payment
All prices displayed on the Website are shown in the currency indicated at checkout.
We reserve the right to change prices at any time. Price changes will not affect orders that have already been confirmed, unless there has been an obvious pricing error.
Payment must be completed through the payment methods available on the Website.
Online payments are processed through secure third-party payment providers or authorised banking systems. LuxElle does not store full payment card details, CVV codes or sensitive payment authentication data.
